CHAPTER 14. TRAFFICCHAPTER 14. TRAFFIC\Article 5. All-Terrain and Unregistered Vehicles

Except as provided herein, it shall be unlawful for any person to operate an all-terrain vehicle, unregistered motorcycle, unregistered motor vehicle or mini motorcycles / pocket bikes upon the streets, alleys, or highways within the corporate limits of the City of Louisburg, Kansas, or within drainage easements of the City of Louisburg, Kansas, pursuant to K.S.A. 8-15,100; and Standard Traffic Ordinance section 114.1. Any person operating such a vehicle exempted in 14-502 or described in 14-504 must possess a valid Kansas Driver’s License, or other valid Driver’s License issued by another State pursuant to K.S.A. 8-235; and Standard Traffic Ordinance section 192.

(a)   Notwithstanding the provisions of Section 14-501, all-terrain vehicles, work-site utility vehicles and other unregistered motor vehicles owned and operated by a county noxious weed department, or all-terrain vehicles owned and operated by persons contracting with the Miami County Weed Department or Kansas Department of Transportation may be allowed to operate such all-terrain vehicles upon the right-of-way of any federal or state highway or county road, provided such vehicles are properly identified, per applicable Kansas Department of Transportation standards, as slow moving vehicles and are operated at less than 10 mph.

(b)   Notwithstanding the provisions of Section 14-501, all-terrain vehicles, work-site utility vehicles and other unregistered motor vehicles owned and operated by USD 416 School District of the City of Louisburg and operated by its employees, may be allowed to operate such all-terrain vehicles upon the streets, alleys, or highways within the corporate limits for the maintenance of the District’s facilities, provided such vehicles are properly identified, per applicable Kansas Department of Transportation standards, as slow moving vehicles and are operated at less than 10 mph.

(c)   Notwithstanding the provisions of Section 14-501, all-terrain vehicles, work-site utility vehicles and other unregistered motor vehicles owned and operated by the City of Louisburg and operated by its employees, may be allowed to operate such vehicles upon the streets, alleys, or highways within the corporate limits for the maintenance of the City’s facilities, walkways, parks and public grounds, provided such vehicles are properly identified, per applicable Kansas Department of Transportation standards, as slow moving vehicles and are operated at less than 10 mph.

(d)   Notwithstanding the provisions of Section 14-501, the Governing Body of the City of Louisburg, Kansas, or the Chief of Police may authorize the operation of such all-terrain vehicles, work-site utility vehicles and other unregistered motorcycles or unregistered motor vehicles: (1) to participate in parades, City-authorized events or other public functions provided the operation of these vehicles be done in a safe and responsible manner or (2) to be operated when the use of the highway by other motor vehicles is impassable because of snow, or other uncontrollable acts.

Unregistered motor vehicles, or all-terrain motor vehicles as allowed herein shall only be allowed to operate on any public highway, street, or road within the corporate limits of the City of Louisburg between sunset and sunrise if equipped with lights as required by law for motorcycles and other motorized vehicles in accordance with those applicable laws.

(a)   As used herein, an all-terrain vehicle is defined as any motorized non-highway vehicle 50 inches or less in width, having a dry weight of 1,500 pounds or less, and traveling on three or more non-highway tires.

(b)   As used herein, an unregistered motor vehicle is defined as being a motor vehicle which does not have a registration certificate or certificates and registration plates issued under the laws of the State of Kansas pertaining to the registration of vehicles, including, but not limited to: those types of all-terrain vehicles commonly known as side-by-sides or recreational off road vehicles where operators and / or passengers sit in a manner whereas they are not straddling the seat while in a partially or fully enclosed passenger compartment, micro-utility vehicles, low-speed vehicles, motorcycles, go-karts, dune buggies, tracked vehicles, snow-mobiles, low power cycles (49cc or less), unlicensed motor scooters and competition motor vehicles. This does not include the all-terrain vehicle defined as a motorized non-highway vehicle which travels on three or more non-highway tires, where the operator straddles the seat to manipulate and steer the motor vehicle by use of handlebars such as in the manner similar to that on a motorcycle.

(c)   Mini-motorcycles, mini-chopper, pocket-bikes and mini-scooters have no official definition in state statute. They are, however, small, unconventional motor vehicles designed, manufactured and intended for operation on private property and closed courses. The owner’s manual and/or manufacturer’s documentation clearly states they are not intended for use on public streets or highways. They do not meet Federal Safety Standards nor EPA emissions requirements and do not have proper vehicle identification numbers. Because they do not conform to these standards, they must be used only on private property where traffic laws are not enforced or closed courses. Any person convicted of a violation of any provision of this article shall be punished by a fine of a minimum of $100.00, but not exceeding $500.00.
