The board of code appeals shall be appointed by the Mayor with the approval of the City Council. The membership of the board shall be consistent with the terms, conditions and qualifications prescribed within the International Building Code.

The board shall establish policies and procedures necessary to carry out its duties. The board shall annually or as frequently as practicable, select one of its members to serve as chairperson. The board shall meet upon notice by the chairperson, within 10 days of the filing of an appeal or at stated periodic meetings.

All hearings before the board shall be open to the public. The appellant, the appellant’s representative, the building official and any person whose interests are affected shall be given an opportunity to be heard. The rules of the hearing shall not be required to comply with strict rules of evidence, but shall mandate that only relevant information be received.

A member shall not hear an appeal in which that member has a personal, professional or financial interest.

The City Administrator shall designate a qualified clerk to serve as secretary to the board. The secretary shall file a dated record of all proceedings to be maintained in the Louisburg Zoning Office.

Board members shall receive a $100 stipend for each meeting attended. The stipend is intended to cover the cost of mileage and time spent performing investigative research.

The application fee for each item appealed shall be $500, non-refundable, to be paid at the time of initial filing. No appeal shall be heard until all required exhibits and fees have been provided to the City.
