A certain document, three (3) copies of which are on file in the Building & Zoning office of the City of Louisburg, Kansas, being marked and designated as the IEBC, 2018 Edition is hereby adopted as the IEBC of Louisburg in the State of Kansas, regulating and governing the repair, alteration, change of occupancy, addition and relocation of existing buildings including historic buildings; providing for the issuance of permits and collection of fees therefore; and each and all of the regulations, provisions, penalties, conditions and terms of said IEBC on file at the office of the City of Louisburg, Kansas, are hereby referred to, adopted, and made a part hereof, as if fully set out in this article, with the additions, insertions, deletions and changes, if any, prescribed in Section 4-1102 of this article.

The violation of this article by any person, whether owner, tenant, contractor or other person, shall be punishable by a fine of not to exceed Five Hundred ($500.00) Dollars for each offense. In case any activity is, or is proposed to be, used in violation of this article, the Building Inspector, City Attorney, or other appropriate authority of the municipality may, in addition to other remedies, institute injunction, mandamus, or other appropriate action or proceeding to prevent such unlawful activity.

If any section, subsection, sentence, clause or phrase of this article is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this article. The Governing Body of the City of Louisburg, Kansas, hereby declares that it would have passed this article, and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional.

Nothing in this article or in the IEBC hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or article repealed by Ordinance No. 1160; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this article.
